TERMS AND CONDITIONS OF SALE (T&Cs)

These Terms and Conditions of Sale ("T&Cs") govern sales concluded between:

Hereinafter referred to as the "Seller",

and

Any natural or legal person making a purchase through the SUBSUB website,

Hereinafter referred to as the "Customer".

ARTICLE 1 – PURPOSE

These Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products offered by SUBSUB.

Any order placed on the website implies unconditional acceptance of these T&Cs.

ARTICLE 2 – PRODUCTS

The products offered for sale are those displayed on the website on the date it is consulted by the Customer.

Product photographs and descriptions are provided for informational purposes only and are not contractually binding.

The Seller reserves the right to modify the product range at any time.

ARTICLE 3 – PRICES

Prices are indicated in euros (€), including all applicable taxes (VAT included where applicable).

The Seller reserves the right to modify prices at any time.

The applicable price is the one displayed at the time the order is confirmed.

Any delivery charges will be indicated before the final validation of the order.

ARTICLE 4 – ORDERS

The Customer selects the products they wish to purchase and confirms the order according to the process provided on the website.

The sale shall be deemed concluded upon the sending of the order confirmation email.

The Seller reserves the right to refuse or cancel any order in the event of:

  • Incorrect information;

  • Suspected fraud;

  • Payment incidents;

  • Exceptional product unavailability.

ARTICLE 5 – PAYMENT

Payment is due immediately upon placing the order.

Payments are secured through the payment service providers offered on the website.

The Seller never has access to the Customer’s banking details.

ARTICLE 6 – DELIVERY

Products are delivered to the address provided by the Customer when placing the order.

Delivery times are provided for informational purposes only.

The Seller shall not be held liable for delays attributable to the carrier, customs authorities, or any event beyond its reasonable control.

The Customer is responsible for ensuring the accuracy of the delivery information provided.

ARTICLE 7 – TRANSFER OF RISK

In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the product passes to the Customer when the Customer takes physical possession of the goods.

ARTICLE 8 – RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has fourteen (14) days from receipt of the product to exercise their right of withdrawal without having to provide any reason.

The product must be returned in its original condition, complete and unused.

Return shipping costs remain the responsibility of the Customer unless otherwise required by law.

The refund will be processed within a maximum period of fourteen (14) days following receipt of the returned product or proof of its shipment.

ARTICLE 9 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised, in particular, for:

  • Unsealed products that cannot be returned for health protection or hygiene reasons;

  • Personalized products;

  • Goods damaged by the Customer.

Snorkeling masks or equipment that comes into contact with the mouth or face may be excluded from the right of withdrawal if they have been used or unsealed after delivery.

ARTICLE 10 – LEGAL WARRANTIES

The Customer benefits from:

  • The legal guarantee of conformity provided for under Articles L.217-3 and following of the French Consumer Code;

  • The warranty against hidden defects provided for under Articles 1641 and following of the French Civil Code.

These warranties apply independently of any commercial warranty that may be offered.

ARTICLE 11 – LIABILITY

The Seller shall not be held liable for:

  • Improper use of the products;

  • Failure to comply with safety instructions;

  • Damage resulting from use of the product in a manner inconsistent with its intended purpose.

SUBSUB products are intended for recreational surface snorkeling use only.

ARTICLE 12 – PERSONAL DATA

Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR) and the website's Privacy Policy.

The Customer has the right to access, rectify, erase, and restrict the processing of their personal data.

ARTICLE 13 – INTELLECTUAL PROPERTY

All elements present on the website (texts, images, logos, videos, graphics, trademarks) remain the exclusive property of the Seller.

Any unauthorized reproduction or use is prohibited.

ARTICLE 14 – FORCE MAJEURE

The Seller shall not be held liable for failure to perform its obligations in cases of force majeure as defined by Article 1218 of the French Civil Code.

ARTICLE 15 – DISPUTE RESOLUTION

In the event of a dispute, an amicable solution shall first be sought.

In accordance with Articles L.611-1 and following of the French Consumer Code, the Customer may use a consumer mediation service free of charge.

Failing an amicable agreement, French courts shall have jurisdiction.
